Toby graduated from Durham University in 1991 (where he captained the 1st XV) and qualified with Allen & Overy in 1995. He joined Slaughter and May’s Hong Kong office in 1997 for three years and was admitted as a solicitor there in 1998. He rejoined Allen & Overy on his return to London in 2000, staying with them until November 2003 when he joined Gibson & Co as a partner.
Toby sits on the CEDR panel of mediators and is regularly selected as a lead mediator for a wide variety of commercial disputes. He gained his higher rights of audience in the Civil Courts in 2001 and is a frequent High Court advocate, obtaining injunctions and representing clients at a number of interlocutory applications. Chambers & Partners described him as “a great tactician and strategist” (in 2008) and "distinguished for his "strategic foresight"" and "in particularly difficult circumstances...a calm head to steer you through the storm" (in 2009).
The 2010 edition of Chambers placed Toby in the top tier of ranked individuals "following superlative client feedback: He didn't leave any stone unturned, he was always available and we felt completely prioritised in his workload."
Toby has handled a wide variety of contentious commercial and financial matters. His areas of expertise include: financial services and derivatives litigation, shareholder disputes, contentious trusts and probate matters, professional negligence and litigating over the terms of numerous commercial contracts (for example, distribution, share sale, asset purchase and option agreements). Toby's interests outside the office include fell running and country sports.
